Terms of service

These terms of service ("Terms") govern your use of the aiactly platform ("Service") operated by aiactly ("we", "us", "our"). By creating an account or using the Service, you agree to these Terms.
1. Service description
aiactly is a self-service compliance platform that helps organisations classify AI systems under the EU AI Act (Regulation (EU) 2024/1689), track compliance obligations, and generate documentation. The Service provides guidance tools only and does not constitute legal advice.
2. Accounts
You must provide accurate information when creating an account. You are responsible for maintaining the security of your account credentials and for all activity under your account. You must notify us immediately of any unauthorised access.
You may sign in using email/password or third-party authentication providers (Google). When using third-party sign-in, you authorise us to access the name and email address associated with that account.
3. Acceptable use
You agree not to:
- Use the Service for any unlawful purpose
- Attempt to gain unauthorised access to the Service or its systems
- Interfere with or disrupt the integrity or performance of the Service
- Reverse engineer, decompile, or disassemble any part of the Service
- Use automated tools to scrape, crawl, or extract data from the Service
- Share your account credentials with third parties
4. Subscriptions and billing
The Service offers free and paid subscription plans. Paid plans are billed monthly through Stripe. By subscribing to a paid plan, you authorise us to charge your payment method on a recurring basis.
You may cancel your subscription at any time through the billing portal. Cancellation takes effect at the end of the current billing period. We do not offer refunds for partial billing periods.
We reserve the right to change pricing with 30 days' notice. Price changes do not affect the current billing period.
5. Intellectual property
The Service, including its design, code, and documentation templates, is owned by aiactly and protected by intellectual property laws. Your use of the Service does not grant you ownership of any intellectual property.
Documents generated through the Service are owned by you. We claim no rights over content you create or upload.
6. Disclaimer
The Service is not a substitute for professional legal advice. Risk classifications, obligation checklists, and generated documents are based on our interpretation of the EU AI Act and are provided for guidance only. Regulatory requirements may change, and our tools may not reflect the most recent amendments.
You are solely responsible for ensuring your AI systems comply with applicable laws and regulations. We strongly recommend consulting qualified legal counsel before making compliance decisions.
7. Limitation of liability
To the maximum extent permitted by law, aiactly shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenue, whether incurred directly or indirectly, arising from your use of the Service.
Our total liability for any claim arising from these Terms or the Service shall not exceed the amount you paid us in the 12 months preceding the claim.
8. Data and privacy
Your use of the Service is also governed by our Privacy policy. By using the Service, you consent to the collection and use of your data as described therein.
9. Termination
We may suspend or terminate your access to the Service if you breach these Terms or if we reasonably believe your use poses a risk to the Service or other users. You may terminate your account at any time by contacting us.
Upon termination, your right to use the Service ceases immediately. We may retain your data for a reasonable period as required by law or legitimate business purposes.
10. Changes to these terms
We may update these Terms from time to time. We will notify you of material changes by email or through the Service. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
11. Governing law
These Terms are governed by the laws of the Republic of South Africa. Any disputes shall be resolved in the courts of South Africa.
